In this case a lady gave her property on rent to a tenant who then refused to pay rent and illegally occupied the property and denied vacating the property. The tenant in order to pressurise the landlady falsely implicated her husband in sexual harassment and rape cases where she admitted being tenant of the property and later on in civil suit cooked up a false story in her defence alleging that she purchased the property from the landlady.

In the present case TSA filed a Civil Suit for recovery of possession and Rent in Civil Court of Sh. Dhirendra Rana, SCJ Rohini court against the tenant and an application under Order XII Rule 6 read with section 151 CPC for passing   a   judgment   based   on   the admission   of   facts   made   by   the tenant.

Hence based on the admissions, material on record and provision of law, the application moved under Order 12 Rule 6 CPC moved by TSA on behalf of landlady was allowed and preliminary decree under order 12 Rule 6 CPC for possession qua property was drawn in favour of landlady and against tenants and same was executed by the Court as Result the Land Lady got the peaceful possession of her premises.
