Brief Facts of the Case

The complainant alleged that the son of the applicant had committed a violent offence and that the applicant had instigated and abetted the commission of the alleged crime. It was further alleged that the applicant was present at the spot along with her son and daughter and had facilitated the offence. Statements of the complainant and two employees were relied upon by the prosecution to implicate the applicant.

Our Approach & Strategy

The defence team at TSA undertook a thorough and rigorous examination of the material placed on record. Upon scrutiny, it was brought to the notice of the Hon'ble Court that neither the initial information nor any independent material substantiated the presence of the applicant at the scene of occurrence. The defence further produced statements of independent witnesses and photographs demonstrating that the applicant was attending a marriage function during the relevant period. It was also highlighted that no inspection of the crime scene had been carried out immediately and that there was considerable scope for embellishment and tutoring of witnesses.

Outcome

Upon appreciating the material placed before it, the Hon'ble Court of Rohini, Delhi was pleased to grant anticipatory bail to the applicant, observing that her presence at the scene of crime had not been established.
