Brief Facts of the Case
The case arose from allegations of sexual assault made against the accused, following which an FIR was registered and a detailed investigation was conducted. Given the gravity of the charges under Section 376, 354 IPC and Sections 6 and 12 of the POCSO Act, the matter involved extensive examination of witness statements, medical records, investigative documents, and other material relied upon by the prosecution.
Our Approach & Strategy
Recognising that every criminal case must be assessed on the strength of the evidence rather than the seriousness of the allegations alone, the defence team undertook a meticulous review of the entire chargesheet. Through careful analysis, the firm identified crucial factual and procedural aspects that required judicial consideration, including inconsistencies in the prosecution's narrative and gaps in the evidentiary record. Leveraging its experience in criminal litigation, TSA prepared a comprehensive bail strategy and advanced detailed submissions before the Hon'ble Court.
Outcome
After considering the material on record and the arguments presented, the Court was pleased to grant bail to the accused. This matter reflects the firm's commitment to thorough preparation, strategic legal thinking, and the principle that every individual is entitled to a fair defence and due process of law, irrespective of the nature of the allegations.
