Brief Facts of the Case
TSA Law Firm successfully represented the accused in a criminal trial involving allegations of attempt to murder, robbery, criminal intimidation, and criminal conspiracy under Sections 307, 394, 506, and 120B IPC. The prosecution alleged that the accused was part of a conspiracy culminating in a violent incident in which the complainant sustained injuries and valuable articles were allegedly taken away. Given the seriousness of the accusations, the case carried severe penal consequences and proceeded to a full-fledged trial.
Our Approach & Strategy
At the heart of the prosecution's case was a chain of circumstances allegedly linking the accused to the offence. However, a detailed examination of the evidence revealed significant shortcomings. The defence team at TSA meticulously analysed witness testimonies, recovery proceedings, investigative records, and other material placed on record. During trial, TSA effectively challenged the prosecution's narrative through strategic cross-examination and detailed legal submissions. The defence highlighted that no reliable witness had conclusively connected the accused to the alleged acts and that crucial gaps remained in the prosecution's version.
Outcome
Upon appreciating the evidence in its entirety, the Hon'ble Court held that the prosecution had failed to prove its case beyond reasonable doubt, further observing that suspicion, however strong, cannot substitute legal proof. The evidence on record did not form a complete chain leading to the guilt of the accused. Consequently, the accused was acquitted of all charges under Sections 307, 394, 506, and 120B IPC.
