Brief Facts of the Case
The prosecution alleged that the accused, along with another person, had attacked the complainant with a sharp-edged weapon in a public park, causing grievous injuries. A case was registered for offences punishable under Sections 307/34 IPC. During the trial, the prosecution examined several witnesses, including the injured witness, an alleged eye-witness, medical experts, and investigating officers.
Our Approach & Strategy
TSA represented the accused throughout the proceedings and effectively challenged the prosecution's case through rigorous cross-examination of prosecution witnesses, highlighting material contradictions, discrepancies in credibility, and inconsistencies in their testimonies. TSA pointed out lacunae in the investigation, including the unexplained delay in registration of the FIR, non-production of CCTV footage, and discrepancies between the testimonies of the planted witnesses. TSA further demonstrated that the alleged eye-witnesses did not support the prosecution version and that the testimony of the injured witness was unreliable.
Outcome
Considering these deficiencies and the failure of the prosecution to establish guilt beyond reasonable doubt, the Hon'ble Court of Rohini, Delhi acquitted the accused. This outcome reflects TSA's commitment to safeguarding the rights of the accused and its meticulous approach towards criminal defence, which ultimately contributed to securing the acquittal.
