Brief Facts of the Case

The complainant lodged an FIR against the accused person, who was her landlord, alleging that he had been harassing and threatening her for some time. It was alleged that on one occasion the accused, along with his wife, threatened her with dire consequences, and on a subsequent occasion assaulted her, attempted to disrobe her, and committed sexual assault. Based on these allegations, an FIR was registered under Sections 323, 354B, 506 and 34 IPC. Subsequently, after the statement of the prosecutrix was recorded under Section 164 Cr.P.C., Section 376 IPC was also added.

Our Approach & Strategy

The defence team at TSA conducted a detailed examination of the prosecution's allegations and brought to the notice of the Hon'ble Court the existence of prior disputes between the parties arising out of their landlord-tenant relationship. It was further pointed out that cross-FIRs were pending between the parties and that the accused had raised a plea of alibi. The defence also demonstrated that the investigation qua the accused had already been completed and the charge sheet had been filed.

Outcome

Through effective advocacy and a comprehensive presentation of the facts and circumstances, TSA persuaded the Hon'ble Court that continued incarceration of the accused was not warranted. Accordingly, the Hon'ble Court of Sessions, Rohini Courts, Delhi was pleased to admit the accused to bail, subject to appropriate conditions.
